These Terms and Conditions ("Terms") govern your use of the website www.eurotunes.com.au and any purchase of products or services from Jimmy Aligiannis trading as Euro Tunes.com.au (ABN 97 396 735 831) ("we", "us", "our").

By using our website or purchasing our products or services, you agree to these Terms. If you do not agree, please do not use our website.

We offer:

• Products: Chip-tuning hardware, ECU tools, software packages, and related automotive equipment

Product descriptions, images, and specifications on our website are provided for general guidance. While we take care to ensure accuracy, we do not warrant that descriptions are complete, current, or error-free. Product appearance may vary slightly from images shown.

3. Pricing and GST

• All prices are displayed in Australian Dollars (AUD) and are inclusive of GST (Goods and Services Tax at 10%)
• Shipping costs are additional and calculated at checkout unless otherwise stated (e.g., "Free shipping Australia-wide on orders over $50")
• We reserve the right to change prices at any time without notice, but price changes will not affect orders that have already been confirmed
• In the event of a pricing error, we reserve the right to cancel the order and refund any amount paid

4. Orders and Acceptance

When you place an order through our website:

1. You make an offer to purchase the products at the prices and terms displayed
2. You will receive an order confirmation email acknowledging receipt of your order
3. A contract is only formed when we accept your order, which occurs when we dispatch the products or commence performance of services
4. We reserve the right to reject or cancel any order at our discretion, including for reasons such as stock unavailability, pricing errors, or suspected fraud. In such cases, we will refund any payment made in full

5. Payment

• Payments are processed securely by Stripe Payments Australia Pty Ltd
• We accept major credit and debit cards as supported by Stripe
• We do not store your full payment card details on our servers
• Payment must be received in full before products are dispatched or services are commenced
• By placing an order, you warrant that you are authorised to use the payment method provided

6. Shipping and Delivery

• We ship Australia-wide. Free shipping is offered on orders over $50 (Australia only)
• Estimated delivery times are indicative only and begin from dispatch (not order placement)
• Title and risk of loss in the products pass to you upon delivery to the address provided
• We are not responsible for delays caused by couriers, customs, or events beyond our reasonable control
• It is your responsibility to provide a correct and complete delivery address. Re-delivery fees due to incorrect addresses are at your expense

7. Consumer Guarantees (Australian Consumer Law)

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

For major failures with the service, you are entitled to:

• Cancel your service contract with us; and
• Obtain a refund for the unused portion, or compensation for its reduced value

You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

Nothing in these Terms limits or excludes any consumer guarantees under the Australian Consumer Law.

8. Returns and Refunds

8.1 Faulty or Misdescribed Products

If a product is faulty, damaged on arrival, or not as described, you are entitled to a repair, replacement, or refund in accordance with the Australian Consumer Law. Please contact us within 14 days of receiving the product.

8.2 Change of Mind

Returns for "change of mind" are accepted at our discretion within 14 days of delivery, provided that:

• The product is unused, in original packaging, and in resaleable condition
• You provide proof of purchase
• Return shipping costs are at your expense
• A restocking fee may apply for high-value items

8.3 Software and Digital Products

Due to their nature, software licences and digital products are non-refundable once activated, delivered, or downloaded, unless required by law (e.g., under the Australian Consumer Law for major failures).

8.4 Return Process

To initiate a return, contact us at info@eurotunes.com.au with your order number and reason for return. We will provide return instructions. Refunds will be processed within 10 business days of receiving the returned item.

9. Warranties

• Products are covered by any manufacturer warranty supplied with the product
• In addition, all products are covered by the consumer guarantees under the Australian Consumer Law
• Warranty claims should be directed to us in the first instance at info@eurotunes.com.au

10. Use of Products — Professional Tools

Many of our products (chip-tuning tools, ECU programmers, software) are professional automotive workshop equipment. You acknowledge that:

• Improper use may damage vehicle components or void vehicle warranties
• Use of such tools may be subject to local laws, emissions regulations, and vehicle roadworthiness requirements
• It is your responsibility to ensure compliance with all applicable laws in your jurisdiction
• We are not liable for damage, loss, or regulatory non-compliance arising from your use of the products, to the extent permitted by law

11. Intellectual Property

All content on our website — including text, images, logos, product descriptions, and graphics — is owned by us or our licensors and protected by copyright and trademark law. You may not reproduce, copy, distribute, or commercially exploit any content without our prior written consent.

12. Website Use

You agree not to:
